What Happened?

As of Friday, September 16th, the FillerUpClub has officially closed
its doors for business. We are forced to close our doors due to a
situation in which a business partner has sequestered a large amount
of cash - approximately $500,000 - and is refusing to reveal its
whereabouts or grant access to it. As you can understand, this has
been a major blow to the FillerUpClub to the point we cannot continue
doing business until the money is recovered.

The good news is the individual is now in jail in Florida on a
separate charge/conviction. So we know his location and he isn't going
anywhere. But, unfortunately, he is refusing to communicate with us
and turn over the money. We gave him until Friday to cooperate with us
or we would pursue further civil and/or criminal action against him.
We did hear from him indirectly twice over the weekend, but he is
still not telling us exactly what we need to know.

The Good News: by all indications at the moment it appears the money
is all still there and can be recovered. We do not have reason to
think the money has been been spent, moved offshore, or divided and
hidden into different accounts. Yes, it is possible this may be the
case, but at the moment there is no evidence this has occurred. So
when we can access the funds, or if the individual decides to
cooperate and turn over the funds, we will be able to begin issuing
refunds right away to all FillerUPClub members.

This week I will be deciding on which Law Firm I want to use (spoke
with about 8 different lawyers and law firms last week), and we will
proceed with civil action according to their recommendations. I will
be cooperating fully with all Texas state and local authorities, as
well as the Attorney General if needed. I hope the situation does not
go that route (civil litigation and criminal charges) because that
could drag on for months. Hopefully, our lawyer will be able to
convince the individual in jail to turn over the money or face a
decade or more in prison.

Can you expect a refund?

Yes, it is my top priority - my only priority in fact - at the moment
to recover these funds and begin sending refund checks to every
FillerUpclub member that is due one. When will this happen? I cannot
say for sure, but I am hoping this will be within 1 or 2 months. I can
only say I will keep you posted every step of the way as events
unfold.

hundreds of emails and dozens of phone calls each day. I do not have a
staff person anymore (had to let them go because couldn't pay them),
so it is just me answering phones. Each person wants detail answers
and spending 15 - 30 minutes on the phone with each person is not
possible. So please be specific with your questions, or wait for us to
send out regular email updates such as this one.

I apologize I do not have all the answers yet. Many people are
calling and asking for details, but the fact is we just don't have all
the answers yet ourselves. So please be patient. We will pass along
any solid information we have as soon as it is available.
